This course aims to
explain what is meant by the history of legislation, the emergence of positive
law, its balance with Islamic legislation, the stages of Islamic legislation,
and the roles it went through: the era of the Messenger, may God’s prayers and
peace be upon him, the era of the companions and followers, the era of the
imams of the sects, the era of imitation, and the era of jurisprudential
awakening in the present era.
Intended learning outcomes
Upon successful completion of
the course, the student will be able to:
1. To explain the
stages of Islamic legislation and the roles it went through.
2. To clarify the
jurisprudential schools, what they are distinguished for, their signs and their
impact on the life of the nation.
3. To explain the
reasons for the emergence of schools of jurisprudence and the reasons for the
differences between them.
4. To balance between
the principles of each of the schools of jurisprudence.
5. To describe the
impact of Islamic legislation on the life of the nation and its virtues.
6. To explain the
state of Islamic legislation in the modern era (its advantages and
disadvantages).
