Overview

The study of this course aims to:

  • Formulating an optimal criminal policy that takes the preventive policy as a strategic goal within the state's general social, cultural, educational, economic, scientific and political policy.
  • Evaluating the reality of the national criminal policy and its compatibility with the legal and international criminal policy.
  • Identify the mechanisms of formulating criminal policy to confront new crimes.
  • Statement of the limits of the legislative authority's commitment to the restrictions and controls established for the policy of criminalization and punishment.

Intended learning outcomes

Knowledge and understanding

    • Knowledge of the historical development of national and international criminal policy and legitimacy and the extent to which the national criminal policy is compatible with legitimacy, given that Islamic law is the primary source of man-made laws, and the legislator's commitment to human rights guarantees established in the ratified agreements.
    • Knowing the technical terminology of criminal policy, strategy and operational plans, knowing the conventions used to deal with criminal phenomena and criminals.
    • Knowing the classifications of criminals and the criminal policy decided by the legislator to reform and rehabilitate them in the light of a balanced executive policy, knowing the standards that govern legislative policy in general and criminal policy in particular
      • Knowledge of the approach and methodology used to study the reality of criminal policy, knowledge of generalities (principles and generalizations, and knowledge of theories related to the philosophical framework of criminal policy).
      • To familiarize the student with the mechanisms of criminal policy and its philosophical framework through preparing weekly reports (writing scientific reports), attending the discussion of master's theses, and submitting a report on field visits (the legislative authority - prisons - courts and prosecution offices).
