Overview

Through it, the student learns about the provisions that pertain to the Muslim family, starting with marriage and the rights of both spouses, in addition to knowing the provisions of divorce, khulaa' and alimony.

Intended learning outcomes

By the end of the course, the student should be able to

1-Understanding the meaning of marriage, its ruling and the pillars of its contract.

2- Understanding some of the marriages prohibited by Islam, such as temporary marriage, minor marriage, and secret marriage.

3- The ability to choose the appropriate marriage.

4- Distinguishing what is permitted from what is forbidden in relation to marriage and marital rights

Teaching and learning methods

The course will be presented to the student through lectures, panel discussions, assignments and exercises, and discussion and dialogue.

Methods of assessments

Methods of evaluating students in this course: (semester work 40% and final 60% )

Term work: divided between written midterm exams, and assignments.

Final exam: midterm 40 and final 60

Marriage: its definition, ruling, and the wisdom of its legality. Engagement: its meaning, ruling, and the wisdom of its legitimacy and delegates.

Competency and the evidence for its observance, the qualities that are required for it, the marriage contract: its time, its contract in the mosque, its pillars: the first pillar: the formula, the temporary marriage contract, the conditions associated with the marriage contract.

The second pillar of the marriage contract: The two parties to the contract: the conditions that must be met by them, the first condition is that there is no coercion, the second condition is that the woman should not be forbidden to the man permanently or temporarily, firstly the forbidden things that are permanently forbidden: because of lineage, because of breastfeeding, because of affinity, secondly the taboos temporarily prohibited.

Polygamy and what is related to it, the third pillar of the marriage contract: the guardian: its definition, guardianship over women is an expression of honor, the conditions for the validity of the guardian, muscle and what is related to it.

Conditions for the validity of marriage: First: The woman should not be forbidden to the man. Second: Witnessing: the wisdom of stipulating it, its time, the status of witnesses, secret marriage.

Follow the conditions for the validity of marriage: The third condition / dowry: its definition, evidence and wisdom of its legitimacy, the inadmissibility of agreeing to drop it, the dowry of the same, the named dowry, the marriage of minors, the least and most of the dowry, exaggeration in the dowry and its negative effects.

The conditions of the dowry: that it be pure, that it be financed, that it be a legitimate beneficiary, that it be able to deliver it, that the amount and term be known, the dislike of postponing it, the marriage of delegation, when the dowry falls.

The feast and the wedding: the feast, its definition, its ruling, its time, its amount, the conditions for answering the invitation to it, the excuses that make it permissible to stay away from it, the wedding and what is related to it.

Effects of marriage: The rights of the spouses: First, the rights of the husband: obedience, which includes: intercourse, raising children, moving with the husband to his house, serving the house, the second right: chastity and avoiding everything that causes suspicion, rules for the woman’s adornment, her permission for a non-Mahram to enter her house, The third right: breast-feeding. The fourth right is to treat the husband’s relatives in a good manner. The child is attached to his father.

The wife's rights: dowry, alimony, housing, alimony deductions, among the wife's rights are visiting her parents, fairness between her and her co-wives, and the wife's preservation of her affiliation and her financial responsibility.

Common rights between spouses: good treatment, enjoyment, inheritance, disobedience and related matters.

Divorce: definition, legitimacy, making it in the hands of a man, its ruling, legitimate divorce, Sunnah divorce, heresy divorce.

Elements of divorce and its conditions, revocable and irrevocable divorce, revocation and its provisions, irrevocable divorce.

Khulaa’, its meaning, the wisdom of its legitimacy and its ruling, its formula, the dispute over divorce and khulaa.’
